FISHER'S EDGE

Terms of Service & Coaching Agreement

Effective Date: 3-19-2026

By completing your purchase and checking the acceptance box, you ("User," "Client," or "Student") agree to the following Terms of Service ("Agreement") with FISHER'S EDGE, its affiliates, and related entities (collectively, "Company," "Fisher's Edge," "we," or "us"). This Agreement governs your use of Fisher's Edge coaching programs, trading techniques, educational materials, community features, live sessions, and related services (collectively, the "Services").

Your use of the Services is also governed by our Privacy Policy.

1. Independent Business — Separation from Trade ATS

Fisher's Edge is an independently owned and operated private company. Fisher's Edge is not Trade ATS LLC, nor is it a subsidiary or legal affiliate of Trade ATS LLC.

Rick Kalonji is recognized as an ATS Certified Coach — a designation granted by Trade ATS LLC — however, this certification does not create a legal partnership, shared liability, or business affiliation between Fisher's Edge and Trade ATS LLC.

Trade ATS LLC assumes no responsibility or liability for the products, services, coaching, or any outcomes associated with Fisher's Edge. Any disputes arising from your engagement with Fisher's Edge must be directed solely to Fisher's Edge.

2. Confidentiality and Intellectual Property

Confidential Information includes all non-public information regarding our coaching methodologies, trading strategies, techniques, frameworks, educational materials, internal communications, community content, and proprietary systems.

You agree that you will NOT: Copy, reproduce, distribute, or republish our content Record or share coaching sessions without written approval Create derivative works based on our materials Share proprietary information publicly or privately Use our materials to compete with Fisher's Edge All intellectual property remains the exclusive property of Fisher's Edge. Unauthorized use may result in immediate termination, permanent removal from the program, legal action, and financial damages.

3. Programs & Pricing

Fisher's Edge offers the following programs:

Monthly Coaching Membership — $97/Month Billed on a recurring monthly basis beginning at checkout and automatically renews unless canceled. Includes access to live coaching sessions, educational content, and general community access.

Developer Program — Available in three payment options:

Option A: Pay in Full (Best Value) Total: $4,747.15 (5% discount applied to base price of $4,997) Includes weekly one-on-one coaching sessions for 12 weeks.

Option B: 3-Month Payment Plan Total: $5,396.76 ($4,997 × 1.08) Three monthly payments of $1,798.92 Includes weekly one-on-one coaching sessions for 12 weeks.

Option C: 6-Month Payment Plan Total: $5,746.55 ($4,997 × 1.15) Six monthly payments of $957.76 Includes one-on-one coaching sessions every two weeks for 6 months.

Payment plans (Options B and C) are non-cancellable once initiated. You are obligated to complete all scheduled payments regardless of usage or participation. Missed or failed payments may result in immediate suspension of access until the outstanding balance is resolved. All payment plan totals reflect a financing adjustment above the base program price and are disclosed at checkout prior to purchase.

Full access to the complete Developer Program curriculum including all materials, sessions, and private community rooms is granted upon enrollment and first payment, as outlined at time of purchase.

License Grant Fisher's Edge grants you a limited, non-transferable, non-exclusive license to use the Services for personal use only. One enrollment permits access for ONE individual only. Additional users require separate enrollments.

Personal Use Only Services are for individual use only and may not be: Shared Resold Sublicensed Distributed Used for commercial purposes without written consent.

4. Community Access

Your community access is determined by your active program: Monthly Membership ($97/mo): General community access, group coaching calls, and standard educational content. Developer Program ($4,997): All general community access plus private, exclusive rooms and elevated coaching access. 3-Month Plan: General community access for the duration of the plan.

Fisher's Edge reserves the right to modify community access tiers at its discretion.

5. Subscription & Billing

Subscriptions are billed on a recurring basis beginning at checkout and automatically renew unless canceled before the next billing date.

All sales are final. Fisher's Edge does not offer refunds on any program, membership, or service. No partial refunds or prorated credits will be issued for any unused portion of any membership or program.

Cancellation; You may cancel your monthly membership at any time before your next billing date. Fisher's Edge reserves the right to suspend or terminate accounts at its discretion. Chargebacks Initiating a chargeback or payment dispute may result in: Immediate account termination Revocation of all program access Collections activity Legal recovery of fees and damages

6. ATS Software — Affiliate Disclosure

Fisher's Edge may recommend or link to Trade ATS software throughout its website and programs. Fisher's Edge participates in the Trade ATS affiliate program and may receive compensation for referrals. All purchases of Trade ATS software are governed exclusively by Trade ATS LLC's own Terms of Service. Fisher's Edge assumes no responsibility for Trade ATS products, billing, or support.

7. Platform Availability & Technology Disclaimer

Fisher's Edge does not guarantee uninterrupted or error-free access to the Services. We are not responsible for disruptions caused by: Third-party platform outages Broker outages Market halts Internet failures Software conflicts Force majeure events

You agree not to rely on the platform for time-sensitive trading decisions.

8. Community, Security, and Acceptable Use

You agree NOT to: Post screenshots or recordings of coaching sessions without written approval Share strategies or proprietary frameworks publicly Distribute login credentials or allow others to access your account Harass or disrespect coaches, staff, or other members Attempt to bypass platform security.

Fisher's Edge reserves the right to remove any user who threatens the integrity of the community.

9. Educational Purpose & No Investment Advice

Fisher's Edge is a coaching and education provider. We do NOT: Provide investment advice Act as financial advisors Recommend specific trades Manage funds.

All information is provided for educational and informational purposes only.

10. No Reliance Clause

You acknowledge that you are not relying on Fisher's Edge for financial, investment, legal, or tax decisions. You are solely responsible for: Your trades Your risk management Your capital decisions Your strategy execution.

Past performance is not indicative of future results.

11. High-Risk Investment Warning

Trading involves substantial risk and is not suitable for all investors. Leverage can magnify both gains and losses. You may lose more than your initial investment.

By agreeing to these Terms, you confirm that: You understand the risks involved You will not trade money you cannot afford to lose You assume full responsibility for outcomes You release Fisher's Edge from liability related to trading losses.

12. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE." Fisher's Edge disclaims all warranties, including: Merchantability Fitness for a particular purpose Non-infringement. We do not guarantee profitability or performance.

13. Limitation of Liability

To the fullest extent permitted by law, Fisher's Edge's total liability shall not exceed the lesser of: The fees paid by you in the previous twelve (12) months, OR $1,000. Fisher's Edge shall not be liable for: Trading losses Lost profits Data loss Business interruption Emotional distress Indirect, incidental, or consequential damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless Fisher's Edge from any claims, damages, liabilities, or legal expenses arising from: Your trading activities Your misuse of the Services Your violation of this Agreement.

15. Governing Law & Arbitration

This Agreement is governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. All disputes shall be resolved through binding arbitration in Virginia, and you waive the right to participate in any class action proceeding.

16. Force Majeure

Fisher's Edge is not liable for delays or failures caused by events beyond our reasonable control.

17. Entire Agreement

This Agreement supersedes all prior agreements and becomes binding upon purchase or enrollment. Fisher's Edge reserves the right to update or modify these Terms at any time. Continued use of the Services constitutes acceptance of any modifications.
